A "Serna Motion" is a motion to dismiss a criminal case for lack of speedy trial or prosecution. We bring these in situations where the prosecutor files a criminal case, but waits an unreasonable time to arrest the defendant, bring him to court or bring him to trial.
Under California law, a judge will look at 3 factors when evaluating a Serna Motion: (1) the length of the delay, (2) the reason or justification for the delay, and (3) the extent to which the delay harmed the defendant.
A successful Sixth Amendment Serna Motion can result in the court dismissing all criminal charges.
